TERMS AND CONDITIONS FOR THE RENTAL OF CASA ROSA, ADELAIDA AND ROSITA, (ie CASA ROSA ESTATE) PERIANA, MALAGA, SPAIN

  1. Rental Contract: A completed and signed Booking Form, along with a non-refundable deposit of 20% of the value of the booking, is required. The rental contract is complete once a confirmation receipt has been issued for full payment and is binding. Bank details for payment are sent out with the Booking Form.

  2. Payment Terms: The FULL rental amount is to be paid 8 weeks before the rental period, or immediately if the holiday has been booked less than 8 weeks before the rental period. Once the confirmation receipt for full payment has been issued, the contract is binding. At this point, the initial 20% deposit becomes the security deposit, which is refundable within 3 weeks of departure, less any deductions for breakage, damage or extra cleaning costs.

  3. Price: We accept sterling and euros and the rental period is calculated on a weekly basis unless otherwise arranged in exceptional circumstances. The price is all inclusive for linen, cleaning, pool maintenance and utilities.

  4. Security Deposit: The initial 20% deposit becomes the security deposit once the full rental amount has been paid 8 weeks prior to the rental period. It is refundable with 3 weeks of departure, less any deductions for breakage, damage or extra cleaning costs if the property is not left as it was found. We ask that you kindly notify us of any breakages.

  5. Cancellation: Cancellation prior to 8 weeks before the rental period will result in the loss of your deposit, unless re-letting of the property is achieved. Cancellation within the 8 weeks before the rental period will result in the loss of your full payment, unless re-letting of the property is achieved. We reserve the right to cancel a booking in the event of late payment of the full amount. This will result in the loss of your deposit, unless re-letting of the property is achieved.

  6. General Information: In the interests of improvement we reserve the right to alter furniture, fittings, amenities and facilities without prior notice. If any material changes occur before your arrival, we will advise you.

  7. Access: The owner, house keeper, concierge, pool maintenance man and gardeners shall be allowed free access to the property at any reasonable time during any holiday occupancy for the purposes of inspection and maintenance.

  8. Arrival and Departure: We try to be as flexible as possible when it comes to arrivals and departures. Our house keeper is very happy to meet late night arrivals to guide you to the house. As a rule we ask guests to leave the property by 10am to give the cleaners a chance to prepare for the next guests. New arrivals should aim to reach the property no earlier than 5.00pm for the same reason. Earlier arrivals must respect the cleaners need to access and clean and can be arranged by prior notification.

  9. Your Responsibilities: You are responsible for all damage or loss which occurs to the property or its contents during your stay and will be responsible for paying appropriate compensation in the event of extra costs incurred by during your stay. This includes extra cleaning services required after departure if the property is not left in a reasonable condition.

  10. Complaints: In the event of any complaints or problems, please contact our housekeeper who will help to resolve the issue. Her details are supplied upon receipt of the booking deposit.

  11. Liability of Property Owner: We shall not be responsible for the death of, or personal injury of, you ar any person named on the booking form or other person at the property unless this results from the proven negligence of us or our employees. We shall not be liable for any loss, breach or delay due to any cause beyond our reasonable control including, but not limited to, act of God, explosion, flood, tempest, fire or accident, war or threat of war, civil disturbance acts, restrictions, regulations, by-laws, or measures of any kind on the part of any government or local authority, strikes, lock-outs, or other industrial actions or disputes or adverse weather conditions. In any such case we shall be entitled to treat the contract as discharged. In the event of such discharge our liability shall be limited to the return of sums paid to us in respect of the unused portion of the rental period, calculated on a pro rata daily basis. We cannot be held responsible for failure, beyond our control, of mechanical equipment such as pumps, boilers, swimming pool filtration systems, etc nor failure of public utilities such as water, gas and electricity. We are not responsible for noise or disturbances originating beyond the boundaries of Casa Rosa or which is beyond our control.

  12. Cleaning: The property is cleaned every Saturday, including during the rental period. If you do not wish the cleaners to come during your stay, please inform the house keeper. Extra cleaning can also be provided by arrangement with the house keeper for an additional charge.

  13. Behaviour: The person signing the contract is responsible for the correct and decent behaviour of all party members while at Cortijo Rosa. Please remember that this is our family home and the paintings, furniture and other effects are much cherished. Please look after them on our behalf.

  14. The Swimming Pools Casa Rosa and Adeleida have open access to their pools which means that it is your responsibility to ensure adequate supervision of your guests, especially young children.

  15. Insurance: It is a condition of booking that your party is covered by comprehensive travel insurance. This should include cover for cancellation or curtailment, emergency medical, baggage, personal effects, personal money, hospital benefit, personal accident/death, personal liability and possible travel delay.

  16. Pets: We do not allow pets unless by specific prior agreement.
